American with Disabilities Act (ADA)
Website Accessibility Compliance
American with Disabilities Act (ADA)
Compliance with Americans with Disabilities Act (ADA) is REQUIRED BY FEDERAL LAW on ALL websites. There is an epidemic of lawsuits against companies for being ADA non-compliant.
The Department of Justice (DOJ) has sued many companies for being non-compliant. Thousands of private lawsuits are filed each year suing companies for being non-compliant and a vastly larger unknown number of cases are settled without going to court after a demand letter has been received by the business. In these cases, the companies have had to:
- Pay their own lawyer.
- Pay the opposing lawyer.
- Pay fines.
- Pay damages.
- Lose valuable time.
- Suffered adverse publicity.
- Make remediation to their website to prevent them from being sued again. (You might as well make remediation now).
We can help you get compliant, so you DON’T GET SUED. Further, your site will be accessible to those with disabilities and can result in more sales.
The ADA does not describe the exact requirements to be compliant, but the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, https://www.w3.org/TR/WCAG21/ have been used by both Courts and the DOJ as a standard to be met.

If you are a small business, expenses incurred in making your website accessible can result in a tax credits, each year.
Small Businesses Tax Credit.
Any business that for the previous tax year had either revenues of $1,000,000 or less or 30 or fewer full-time workers may take a tax credit for wesite accessibility costs.
This credit can cover 50 percent of the eligible access expenditures in a year up to $10,250, with the first $250 excluded from credit (resulting in a maximum credit of $5,000).
Example. Let’s say a business spent $2,250 on accessibility for its website. The first $250 isn’t credited, so 50 percent of the remaining $2000 would result in a $1,0000 tax credit.
To claim your website accessibility credit, use IRS Form 8826.
Our services for small business often are less than $1,000 per year by monthly subscription, so approximately half of what you spend is reimbursed by the government.
